Brief calls for equality
WASHINGTON — The University of North Carolina School of Law’s Professor Maxine Eichner was cited in The American Constitution Society for Law and Policy (ACS) brief saying that the only way that lesbian, gay and transgender persons would ever achieve workplace equality was when the Employment Non-Discrimination Act (ENDA) was affirmed and enacted. She called on Congress to work toward passage of ENDA.
While many were able to celebrate Labor Day fully, the LGBT community could not as their workplace civil liberties were not enjoyed.
So far, she said, the Civil Rights Act of 1964, among other legislation, has helped to protect employees.
In an ACS press release, Eichner said, “ENDA…would ban discrimination based on sexual orientation and gender identity with respect to hiring, firing, and terms of employment. The bill would also protect workers from retaliation. In this way, ENDA is an important step toward ensuring fairness for LGBT workers. The legislation stands for the proposition that like other employees, gay, lesbian, bisexual, and transgender employees should be judged based on their work performance, rather than on their sexual orientation or gender identity.”
“Citing a recent CareerBuilder.com study, Eichner notes that 28 percent of LGBT workers reported suffering from workplace discrimination.”
